By accessing or using Scaped.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Scaped.ai provides AI-powered lead generation tools for landscaping and home improvement contractors. The Service includes property visualization, campaign management, and direct mail delivery through USPS. AI-generated images are visualizations and may not represent exact outcomes.

3. Account Registration

You must create an account to use the Service. You agree to:

Provide accurate and complete registration information.
Maintain the security of your account credentials.
Notify us immediately of unauthorized account access.
Accept responsibility for all activity under your account.

4. Acceptable Use

You agree not to use the Service to:

Send misleading, fraudulent, or deceptive mailings.
Violate any applicable laws, including CAN-SPAM and USPS regulations.
Harass, threaten, or send unsolicited mailings to individuals who have opted out.
Misrepresent your business, services, or qualifications.
Reverse engineer, scrape, or misuse the Service or its AI capabilities.

5. Payments and Credits

Scaped.ai operates on a credit-based system. Credits are purchased in advance and never expire. All purchases are final and non-refundable, except where required by law. If a mailer fails to deliver due to a Service error, we will credit your account for the affected mailers.

6. AI-Generated Content

AI-generated property visualizations are artistic interpretations and do not constitute professional landscaping plans, engineering assessments, or guarantees of feasibility. You are responsible for ensuring that any services you offer to homeowners are accurately represented.

7. Intellectual Property

You retain ownership of your business branding and content uploaded to the Service. AI-generated visualizations created through the Service are licensed to you for use in your marketing campaigns. The Service itself, including its design, code, and AI models, remains the property of Scaped.ai.

8. Limitation of Liability

Scaped.ai is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through your profile settings. Upon termination, unused credits are forfeited unless otherwise required by law.

10. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance. We will provide notice of material changes via email or platform notification.
